AmTrust Specialty Limited (ASL), a UK-regulated specialty lines insurer, successfully obtained authorisation from the Australian Prudential Regulation Authority (APRA) to operate as a Category C general insurer (foreign branch) in Australia. The license was approved on 9 February 2026, enabling ASL to actively grow its Legal Expenses insurance business in the Australian market.

The Challenge

AmTrust identified that the Legal Expenses insurance market in Australia was underdeveloped and underserved, presenting a significant growth opportunity. The company had been operating in Australia as an Unauthorised Foreign Insurer (UFI), but this structure prohibited active marketing and business development activities.

To capitalise on the market opportunity and align with Group strategy, AmTrust sought to establish an APRA-regulated Category C Insurer (Branch) in Australia. This would enable the company to actively grow its Legal Expenses business while maintaining integration with its existing UK operations and governance frameworks.

APRA’s licensing process demands comprehensive documentation, addressing multiple prudential standards, including:

OUTCOME
The branch structure was selected as the most appropriate pathway, allowing AmTrust to leverage its existing Head Office governance and underwriting infrastructure while meeting Australian regulatory requirements.

PFS led the development of the Pre-Application Business Plan, a comprehensive document submitted to APRA to demonstrate viability and regulatory readiness.

The Pre-Application Business Plan demonstrated that AmTrust would combine its knowledge and experience of the Australian market with existing governance, risk management, and underwriting capability.

Following APRA feedback on the pre-application, PFS managed the preparation of the formal licencing application. This involved Business Plan refinement and comprehensive policy and framework development across governance, risk management, capital, reinsurance along with financial and modelling calculations and APRA liaison.

Throughout the assessment process, PFS managed ongoing APRA engagement:

  • Direct correspondence with APRA licensing and supervisory teams
  • Response to information requests, providing clarifications and additional documentation as required
  • Updates to application materials based on regulatory feedback, including iterations of the business plan and policy documents
  • Management of assessment timeline, tracking progress from submission through to “substantially complete” determination

Once the above was completed to APRA’s satisfaction, the application was deemed substantially complete.

PFS provided support through the final approval stages:

  • Response to final queries on capital management and governance arrangements
  • Preparation for post-licensing requirements
  • Coordination of approval documentation and communication with stakeholders

On 9 February 2026, APRA granted authorisation for AmTrust Specialty Limited to carry on general insurance business in Australia as a Category C insurer.

PFS was appointed as the Appointed Actuary for the Australian Branch, providing:

  • Financial Condition Reports (FCR) and Actuarial Valuation Reports (AVR) consistent with the Branch Actuarial Advice Framework and APRA’s CPS 320
  • Ongoing oversight of capital adequacy and ICAAP monitoring

Regulatory Compliance

  • Assistance with the preparation of APRA Connect quarterly returns, including Prescribed Capital Amounts, Premium and Claims Liability calculation and Insurance Risk Charge returns
